Bei einer Nichtigkeit des MietenWoG Bln würde der Vermieter die Differenz zwischen der im Mietvertrag vereinbarten Miete (742 Euro) und der nach dem MietenWoG Bln zulässigen Miete (360 Euro) seit dem Beginn des neuen Mietvertrags nachfordern, also ab 1. November 2020. Die Kaution beträgt in beiden Fälle 3 mal die Miete.

Die angebotene Wohnung:
Es handelt sich um eine sehr gut geteilte 2-Zimmer-Wohnung. Die typische Berliner sanierte Altbauwohnung liegt im dritten Stock und hat Dielenboden und hohen Decken (3,1 m).
Die warme Räume sind unmöbliert aber die Küche hat eine EBK mit Spülmaschine, Induktionsherd, Backofen und Kühlschrank. Waschmaschine ist nicht verfugbar. Für die Raumverteilung die Wohnungsplanung sehen. Haustiere sind erlaub.

Die gesuchte Wohnung ändert sich abhängig davon ob sie in München oder Berlin liegt:

>> München: in München City, mindestens 2 Zimmer und maximal Warmmiete 1600 €. Haustiere ERLAUBT.

>> Berlin: in der Nähe der TU Berlin, mindestens 1 Zimmer, eine separate Küche und maximal Warmmiete 550 €. Haustiere IRRELEVANT.

If the MietWoG Bln were to be null and void, the landlord would demand the difference between the rent agreed in the rental agreement (742 euros) and the rent permitted under the MietWoG Bln (360 euros) since the start of the new rental agreement, i.e. from November 1, 2020.
